ACCC moves on Allphones

The Australian Online today has an article that states that the ACCC has agreed to represent more than 100 current and former franchisees of Allphones in a proposed class action. The allegations are that Allphones Retail did not pay bonuses, rebates and compulsory charges to their franchisees.

The ACCC action started after a Sydney franchisee, Hoy Mobile, took independent action against Allphones in the Federal Court. In that case, heard last June, the Federal Court found that Allphones had acted with “calculated dishonesty” and “continuing deceit” by withholding commission payments from the then franchisee.

If this proposed class action led by the ACCC is successful, Allphones could face a damages bill in excess of $7.5million if the court awards damages similar to those in the Hoy Mobile case.

    Soooo where does that leave everyone else especially the Bakers Delight complainants who were left out in the cold by the countrys watch dog.

    Looks like the ACCC is capable of making a stand, but then this is easy when the case is already under litigation and laid out on a silver plater…. the work has already been done at a huge expense no doubt by Hoy mobile. Now that is what I call riding on coat tails.
